1. General
These General Terms and Conditions apply to all quotations, orders, purchases and agreements relating to artworks offered by MikoArt.

By placing an order, the customer acknowledges having read and accepted these Terms and Conditions.

2. About MikoArt
MikoArt is the artistic label under which Dutch digital artist Miechel Kockelkoren creates and sells exclusive original artworks and museum-quality fine art editions.

3. Products
Every artwork is produced with the utmost care using premium materials.

Product photographs, dimensions and colours are presented as accurately as possible. Minor variations in colour may occur due to differences in monitor calibration, lighting conditions and the handcrafted finishing process.

Because every artwork is individually produced, slight variations are part of the unique character of the artwork and do not constitute a defect.

4. Made-to-Order Production
All MikoArt artworks are produced exclusively to order.

Production starts only after the order has been confirmed.

The standard production time is approximately 10–20 business days, unless otherwise agreed.

5. Prices
All prices displayed on the website are stated in Euro (€) unless otherwise indicated.

MikoArt reserves the right to change prices without prior notice. The price confirmed at the time of ordering remains valid for that order.

6. Payment
Orders are processed only after payment has been received or after another agreed payment arrangement has been confirmed.

Accepted payment methods are displayed during the checkout process or communicated personally.

7. Shipping
Every artwork is professionally packaged to ensure safe transport.

Delivery times are estimates and may vary depending on production schedules, destination and courier services.

MikoArt cannot be held responsible for delays caused by shipping companies or customs authorities.

8. Shipping Damage
Customers are requested to inspect their shipment immediately upon delivery.

Any transport damage must be reported as soon as possible, preferably within 48 hours, accompanied by clear photographs of:
the shipping box;
the packaging materials;
the damaged artwork.

The original packaging should be retained until the claim has been resolved.

9. Returns
Because every artwork is produced specifically to order, returns or cancellations are not accepted once production has started, except where required under applicable consumer protection legislation or in the event of proven transport damage or a manufacturing defect.

Where a justified claim exists, MikoArt will provide an appropriate solution, which may include repair, replacement or another suitable remedy.

10. Intellectual Property
All artworks, photographs, texts, designs, logos and other content displayed on this website remain the exclusive intellectual property of MikoArt.

No content may be copied, reproduced, published, distributed or used commercially without prior written permission.

The purchase of an artwork does not transfer copyright or reproduction rights.

11. Certificate of Authenticity
Every original Liquid Gloss® one-of-one (1/1) artwork is supplied with an official Certificate of Authenticity.

The certificate confirms the authenticity and exclusive status of the artwork.

12. Liability
MikoArt shall not be liable for indirect, incidental or consequential damages arising from the use of this website or the purchase of an artwork, except where liability cannot legally be excluded.

13. Privacy
Personal data is processed in accordance with the MikoArt Privacy Policy and applicable privacy legislation.

14. Applicable Law
These Terms and Conditions are governed exclusively by the laws of The Netherlands.

Any disputes shall be submitted to the competent court in the Netherlands unless mandatory law provides otherwise.

15. Amendments
MikoArt reserves the right to amend these General Terms and Conditions at any time.

The version published on the website at the time an order is placed shall apply.
